Terms of Service

Introduction
These Terms of Service (“Terms”) are a legal agreement between you and Dunwell Labs LLC (“we,” “us,” or “our”). They govern your use of Kumbuku (“Kumbuku,” the “Service”) — the personal growth and self-alignment platform available at kumbukuremember.com and through our web and mobile applications.
By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
The Service is intended for users who are at least 13 years old. If you are under 13, you may not use Kumbuku.
Account Registration
To use Kumbuku, you must create an account with accurate information, including a valid email address and, if you choose, a phone number. You are responsible for keeping your account information up to date.
You are responsible for maintaining the security of your account and for all activity that occurs under your credentials. Keep your password confidential and do not share your account with others. Each person may maintain only one account.
If you believe your account has been accessed without authorization, notify us promptly at hello@kumbukuremember.com.
We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or pose a risk to the Service or other users.
Subscription and Payments
Kumbuku offers free and paid subscription tiers. Paid subscriptions are processed by Stripe. By subscribing, you also agree to Stripe's applicable terms and policies. We do not store your full payment card details — Stripe handles payment data directly.
Paid subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You can cancel through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period, and you retain access to paid features until that period ends.
We may change subscription pricing with reasonable advance notice to existing subscribers. Refund requests are handled on a case-by-case basis — contact hello@kumbukuremember.com if you have questions about a charge.
Failure to pay may result in downgrade or suspension of paid features until payment is resolved.
User Content
You retain full ownership of all content you create in Kumbuku — including notes, goals, actions, values, journal entries, and any other data you enter or upload (“User Content”). We do not claim ownership of your User Content.
By using the Service, you grant Dunwell Labs LLC a limited, non-exclusive license to store, process, and display your User Content solely as needed to operate and provide the Service to you. This license ends when your content is deleted from our systems, subject to any retention described in these Terms or required by law.
We do not use your User Content to train AI models. You are responsible for your User Content and agree not to use Kumbuku to store or transmit content that is illegal, harmful, abusive, or that infringes the rights of others.
You may request deletion of your content by contacting us at hello@kumbukuremember.com. We will process deletion requests within 30 days.
AI Features
Kumbuku uses artificial intelligence, powered by OpenAI, to provide features such as daily note distillations, action extraction, and weekly reflections. To deliver these features, relevant User Content (such as notes and goals) may be sent to OpenAI's API for processing.
This processing is for inference only — to generate a specific response for you. Your content is not used to train AI models. See our Privacy Policy for more detail on how we handle data sent to AI providers.
AI-generated suggestions are proposals only. You retain full control over your data and must review and approve any changes before they take effect in your account.
AI outputs may be inaccurate or incomplete. Do not rely on them as professional advice — medical, legal, financial, psychological, or otherwise. Always use your own judgment before acting on AI suggestions.
Google Calendar Integration
You may optionally connect your Google Calendar account to import calendar events into Kumbuku. This integration is read-only — Kumbuku does not create, modify, or delete events in your Google Calendar.
Google Calendar data is used solely to provide the import feature. We do not sell, share, or use Google Calendar data for advertising or any purpose beyond this feature.
You can revoke Google Calendar access at any time through your Kumbuku account settings or through your Google Account permissions.
SMS Features
You may optionally provide a phone number to receive SMS reminders and notifications through Twilio. Standard message and data rates from your mobile carrier may apply.
Phone numbers are used only for the SMS features you enable. We do not sell or share your phone number with third parties for marketing purposes.
You can opt out of SMS at any time by updating your account settings or by replying STOP to any message we send you.
Acceptable Use
You agree to use Kumbuku responsibly and in compliance with these Terms and applicable law. You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to the Service, other accounts, or related systems
- Reverse engineer, scrape, or copy the Service or its underlying technology
- Use automated tools (bots, scrapers, or similar) to access the Service without our written permission
- Upload malicious code, viruses, or harmful content
- Harass, impersonate, or harm other users
- Violate any applicable laws or regulations
Service Availability
We aim to provide a reliable Service, but we do not guarantee 100% uptime or uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors outside our control. We will try to provide notice before planned maintenance when practical.
We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice where possible.
We are not liable for any loss, inconvenience, or data unavailability caused by service interruptions, downtime, or changes to the Service.
Intellectual Property
Kumbuku, including its branding, design, software, and all content provided by us (excluding your User Content), is owned by Dunwell Labs LLC and protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written permission.
The Kumbuku name and logo are trademarks of Dunwell Labs LLC. Unauthorized use is prohibited.
Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be error-free, uninterrupted, secure, or meet your specific needs.
AI-generated content and other features are provided for personal, informational purposes only. They are not a substitute for professional advice — including medical, legal, financial, or psychological advice. Always consult qualified professionals for matters that require expert guidance.
Limitation of Liability
To the fullest extent permitted by law, Dunwell Labs LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service — including loss of data, loss of profits, or personal injury — even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the Service is limited to the amount you paid us for the Service in the twelve (12) months preceding the claim.
Some jurisdictions do not allow certain liability limitations. In those jurisdictions, our liability is limited to the fullest extent permitted by applicable law.
Termination
You may request deletion of your account and associated data at any time by contacting hello@kumbukuremember.com. We will process deletion requests within 30 days.
We may suspend or terminate your account if you violate these Terms. For serious violations, we may act without prior notice. For less serious issues, we may provide warning when appropriate.
Account termination does not automatically delete your data. To delete your data, you must submit a deletion request. We may retain certain information where required by law (for example, payment records processed through Stripe).
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page.
For material changes, we will notify you by email or through an in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service and close your account.
Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of the Service will be resolved in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
